I now consult on ethical AI integration in film, so I see both the hype and the reality up close. The panic around AI art feels familiar and often overblown. From actually implementing these tools in production, the gap between hype and reality is wider than it looks.
The legal uncertainty that actually matters Two headline cases frame the risk. In the U.K., the High Court issued a key ruling on November 4, 2025 in Getty Images v. Stability AI. The court largely rejected Getty’s copyright claims, held that Stable Diffusion does not store or reproduce Getty works, and found only limited trademark infringement tied to watermark issues. That narrows copyright exposure in the U.K., but it does not settle questions elsewhere. In the United States, Andersen v. Stability AI remains active in the Northern District of California. The case has had multiple amended pleadings and procedural steps, with no final merits ruling. Translation for producers: risk is evolving, not resolved. Ownership and terms are the real business stop sign Even if you accept unresolved litigation risk, platform terms can still make commercial use a nonstarter. Some text to video services, such as Kling by Kuaishou, grant themselves a broad, worldwide, non exclusive, royalty free, and irrevocable license to use user inputs and outputs for service operation and improvement. That kind of grant complicates exclusivity and chain of title for brands and studios unless you negotiate enterprise terms that limit reuse and training. Always read the clause, then clear it with counsel. Production reality beats demos Yes, the latest AI video tools can deliver striking clips that run a few seconds. The trouble begins when you need multi shot continuity, character persistence, and scene to scene style control across real timelines. Vendor notes and independent tests acknowledge improvements, yet users still report drift, short clip lengths, and heavy human stitching in post to hit professional standards. In practice today, these tools assist. They do not deliver longform narrative at scale on their own. What major buyers are actually doing Buyers are putting guardrails in writing. Studio and streamer guidance treats generative AI as a creative aid, requires disclosure, bars tools from storing or training on production data, prefers enterprise secured environments, and keeps generated material out of final deliverables without approvals. This is not a ban. It is a framework that pushes responsible, limited use backed by legal review. Across industry events in 2025, the pattern is similar. Panels highlight careful, workflow specific use cases and reinforce the need for clear rights, consent, and provenance controls, rather than wholesale substitution for final content. Labor protections are moving The 2023 WGA MBA created bright lines. AI cannot write or rewrite literary material. AI output is not source material for credit purposes. Companies cannot require writers to use AI. Writers may choose to use AI with company consent, under applicable policies. SAG AFTRA’s 2025 Interactive Media Agreement adds specific consent and disclosure requirements for digital replicas and generative uses of performers’ recognizable likeness, with compensation terms. The direction of travel is clear. What history still teaches Every so called revolutionary tool shifts tasks rather than erasing craft. The industry evolves, but storytelling, visual language, pacing, and emotional intent remain the core value. AI can generate material quickly. It still cannot understand why a moment needs a specific emotional beat or when to bend the rules for impact. That is why buyers insist on human oversight and documented chain of title. The ownership problem still kills weak business cases Major IP holders and brands need clean rights. They need to merchandise, license, and defend without surprises. If a tool’s training corpus is contested, or its terms claim broad reuse rights over your inputs and outputs, that raises red flags for high stakes productions and campaigns. Studios will not risk nine figure assets on ambiguous ownership. Streamers will not accept unclear provenance for originals. Brands will not anchor a global campaign to assets that create legal uncertainty. What I tell clients Use AI where it is strong and defensible. That means pre-production exploration, previs beats, pitch deck visualization, or selective asset generation under enterprise terms, with humans in full creative control and rights handled up front. Be candid about continuity and scale limits, and document every AI touchpoint for approvals and credits where required. Bottom line The hype cycle is cresting. The market is discovering that tools with unsettled legal status, that do not provide production safe ownership assurances, and that struggle with longform coherence are not a turnkey replacement for professional pipelines. AI is changing workflows and can speed up parts of the process. Until rights, chain of title, and multi shot coherence are solved together, generative AI is a powerful assistive layer, not a production engine on its own.
